General terms and conditions of Deluxe Clinics

These general terms and conditions apply to all treatment agreements concluded by Deluxe Clinics, insofar as the work is carried out within the framework of the clinic. The general terms and conditions are available at all times upon request of the client and can be sent if desired.

 

1. General

In these general terms and conditions the following terms are understood to mean:

  1. Client: The (legal) person who enters into an agreement with Deluxe Clinics and agrees to these general terms and conditions.
  2. Practitioner: Deluxe Clinics.
  3. Treatment agreement: The agreement between Deluxe Clinics and the client concerning a treatment.

2. Treatment agreement and Informed Consent

  1. The client enters into a treatment agreement with Deluxe Clinics.
  2. When the client agrees in writing to an operation, this is considered a binding agreement. The cancellation conditions, as described in article 5.5, apply from that moment on.
  3. A signed informed consent form or a signed treatment agreement is binding for both parties.
  4. In order to enter into a treatment agreement, the client must have reached the age of 16, regardless of the age of the patient.
  5. The treatment agreement comes into effect when the client gives the order to perform services to Deluxe Clinics.
  6. Deluxe Clinics reserves the right to outsource certain activities to third parties, if and to the extent that this is necessary for the proper execution of the agreement. No prior consent from the client is required for this outsourcing.
  7. The client is fully informed prior to the treatment about the expected result, possible complications and risks.
  8. Before the start of treatment, the client must sign an informed consent form, in which he/she agrees to the proposed treatment and the associated risks and complications.

3. Applicability of the General Terms and Conditions

  1. These terms and conditions apply to every offer, quotation and treatment agreement of Deluxe Clinics, even if Deluxe Clinics engages a third party to execute them.
  2. Deluxe Clinics has the right to change these general terms and conditions.
  3. Deviation from these general terms and conditions is only possible if Deluxe Clinics has expressly agreed to this in writing.
  4. The client’s general terms and conditions are not accepted.
  5. Before concluding the treatment agreement, the clinic will inform the client and/or patient about:
  1. the intake procedure used
  2. the (intended) results and (possible) consequences of the treatment
  3. alternatives for the treatment
  4. the price of the treatment and the method of payment
  5. the time and place of the treatment
  6. the cooling-off period
  7. the information and instructions for the patient to follow prior to the treatment
  8. the instructions for guidance, care, transport and accessibility
  9. the instructions for the patient after treatment, including symptoms that require the patient to contact the clinic and details of the contact person

4. Obligations of Deluxe Clinics

    1. Deluxe Clinics shall exercise the care of a good clinic in its activities and shall act in accordance with the responsibility resting on it, as it arises from the applicable professional standards and guidelines of the professional group.
    2. Deluxe Clinics shall execute the treatment agreement to the best of its knowledge and ability, in accordance with the requirements of good craftsmanship.
    3. Deluxe Clinics uses registered medicines, implants and other medical devices, the origin of which can be traced.
    4. Without prejudice to the provisions of the first paragraph, the clinic shall comply with the guidelines and standards of the Healthcare Institutions Quality Act when concluding and executing the treatment agreement. If the assessment criteria deviate from these general terms and conditions, the general terms and conditions shall prevail.
    5. Upon discharge from the clinic, a meeting shall take place between the client and an authorised employee, during which the instructions necessary for aftercare shall be discussed. If necessary, the instructions shall be provided in writing. 6. Deluxe Clinics adheres to the planned treatment, intervention or operation.
    6. The clinic sets up a file regarding the treatment of the client.
    7. Among other things, the following data is recorded:
    8. Deluxe Clinics will destroy the documents it has retained within three months of the client requesting this. Destruction will be postponed if it is reasonably likely that the retention is important to a party other than the client, or if destruction is not permitted by law.
    9. Unless destruction has been requested earlier, the clinic will retain the documents in the file for five years from the moment of production, or for as much longer as follows from the care of a good clinic.
    10. Deluxe Clinics uses an ethical code that sets out the standards and values ​​of the organisation, including expectations regarding the treatment of clients and the behaviour of employees.

5. Cancellation, Termination or Changes

  1. Cancellation or changes to the appointment must be made at least 24 hours before the treatment.
  2. The client and the practitioner can terminate the agreement at any time. If the client has purchased a package and cancels it, the remaining package rights (100%) will expire and no refund will be made.
  3. No costs will be charged for cancelling a clinic visit, unless it is explicitly stated in a specific promotion or on a voucher and/or gift card that cancellation is not possible.
  4. If the client informs the practitioner of the cancellation less than 24 hours before the treatment or does not show up, the remaining package rights (100%) will expire and no refund will be made.
  5. If the client has made a deposit for a treatment and cancels this treatment, the deposit (100%) will expire and no refund will be made. 6. If the client does not show up on the day of the treatment without any notice, the remaining package rights (100%) will be forfeited and no refund will be made.
  6. Cancellation of a treatment due to illness or injury requires a signed written medical statement from the general practitioner or treating specialist. In this case, the payment will be refunded.
  7. Both Deluxe Clinics and the client reserve the right to change the date and/or time of the treatment in the event of demonstrable special circumstances (force majeure).

6. Confidentiality

  1. Deluxe Clinics is obliged to maintain confidentiality towards third parties who are not involved in the execution of the assignment. This confidentiality obligation applies to all confidential information provided by the client to Deluxe Clinics.
  2. Deluxe Clinics is entitled to use this information for statistical purposes, provided that the information is fully anonymized.
  3. Deluxe Clinics will ensure that the information cannot be traced back to an individual client.

7. Privacy

  1. Deluxe Clinics uses a privacy policy that is made available to the client upon request.
  2. Without the client’s permission, the clinic will not perform any activities that can be observed by anyone other than the client.

8. Rates and Payments

  1. Deluxe Clinics has the right to change rates. The rate stated on the Deluxe Clinics website at the time of treatment applies to each treatment.
  2. Prices for current treatments and packages remain unchanged. The same applies to quotes, provided that they fall within the validity period.
  3. The validity period of a quote is a maximum of six months. After this period has expired, a new agreement and/or quote must be drawn up.
  4. Deluxe Clinics has no agreements with health insurers. You must therefore pay the costs for your treatment yourself.
  5. The prices stated (for example on the website, in a quote or in a treatment agreement) are subject to typing errors.
  6. If a repeat session is required, costs will be charged again. This is explicitly stated to make you aware of a possible additional expense.

9. Damage or Loss of Property

  1. Deluxe Clinics is not liable for damage to or loss of client property (both inside and outside the building). The client must take the necessary care to prevent damage to or loss of his property.

10. Payment terms

  1. Deluxe Clinics may request a deposit from the client prior to treatment.
  2. The full price is only due on the day of treatment.
  3. Payments must be made on the day of treatment at the clinic.
  4. We accept payments via bank transfer and cash payments at the clinic.
  5. Deluxe Clinics does not accept credit card payments and does not offer the option of payment in installments.

11. Visual material

  1. If the client gives permission for visual material (photos, videos) to be made for medical purposes, this will only be used to record the treatment process.
  2. Use of visual material for other purposes, such as publication on the website, Instagram and Facebook, will only take place with the written permission of the client.

12. Results of Medical and Cosmetic Treatments

  1. Practitioners working at Deluxe Clinics are BIG-registered.
  2. All treatments performed by Deluxe Clinics fall under medical and/or cosmetic treatments. The treatment agreement concerns an obligation of effort and not an obligation of results.
  3. The practitioners have an obligation of effort to perform the treatments to the best of their knowledge and ability, but do not guarantee a specific result.
  4. For treatments where the result depends on individual factors such as skin type, age, body reactions and healing processes, Deluxe Clinics cannot offer a specific result guarantee.
  5. No guarantee can be given on results or an undisturbed course of the treatment.
  6. Complications may occur, such as swelling, anesthesia problems, thrombosis (leg), infection, bruising, tissue death/necrosis, hypertrophic or abnormal scar and numb skin. 7. Absolute symmetry cannot be guaranteed for bilateral procedures. Sometimes a correction or touch-up may be necessary to achieve a good end result. Depending on the type of treatment, this should take place within 14 to 28 days after the treatment date. However, this is not mandatory. 8. In some cases, an additional operation or revision is necessary to achieve a good end result. This additional operation entails additional costs.
